Welcome to the “please read this before things get weird” section. Below you’ll find our Privacy Policy. Using our site means you agree to them, and reading them now is significantly more fun than arguing about them later.

This Privacy Policy explains how Retroactive Entertainment, LLC, doing business as Already Gone (“Retroactive Entertainment,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you visit https://alreadygone.net (the “Site”), create an account, purchase merchandise or digital downloads, sign up for our email list, join our SMS messaging programs, or submit photos, video, audio, or other content to us (collectively, the “Services”).

If you do not agree with this Privacy Policy, please do not use the Services.

1) Information We Collect

A) Information you provide to us

  • Account information: name, email address, username, password (stored in hashed form), and any profile details you choose to provide
  • Contact and mailing list information: name, email address, mobile phone number, city/state or ZIP code, and any preferences you share when you subscribe
  • User Content: photos, video, audio, text, messages, and other material you upload or submit to us, along with any name, contact details, or caption information you provide with it
  • Orders and support: shipping address, order details, and your communications with us
  • Ticketing and events: information you provide when purchasing tickets or contacting us about a show
  • Promotions, surveys, and contests: entry information and any details you voluntarily submit
  • Other information: anything else you choose to provide

Payment information: Payments are processed by third-party payment processors. We do not store full payment card numbers.

B) Information collected automatically

When you use the Site, we may automatically collect:

  • Device and usage data: IP address, device identifiers, browser type, pages viewed, clicks, referring and exit pages, approximate location derived from IP address, and timestamps
  • Cookie and tracking data: information collected via cookies, pixels, tags, and similar technologies for analytics, performance, security, and advertising

C) Information from third parties

We may receive information from:

  • Payment processors, ecommerce platforms, and fulfillment or shipping providers (for example, payment confirmations and shipping updates)
  • Ticketing platforms and venue box offices in connection with our performances
  • Email and SMS service providers regarding delivery, opens, clicks, and opt-out status
  • Our content submission platform regarding material you have submitted to us
  • Advertising and analytics partners regarding ad measurement and campaign performance
  • Social media platforms if you interact with our pages or content

2) How We Use Information

We use information to:

  • Provide, maintain, and improve the Services
  • Create and manage accounts
  • Process orders and deliver merchandise and digital downloads
  • Receive, review, store, and use content you submit to us
  • Send you information about upcoming shows, ticket on-sales, music and video releases, giveaways, and other news you have asked to receive
  • Respond to your questions and provide customer support
  • Personalize content and improve Site functionality
  • Detect, prevent, and investigate fraud, abuse, security incidents, and illegal activity
  • Measure advertising effectiveness and deliver advertising, including interest-based advertising
  • Comply with legal obligations and enforce our terms

3) Email Marketing

If you subscribe to our email list, we collect your email address and any preferences you provide, and we use an email marketing platform to manage the list and send messages. That platform processes subscriber information on our behalf and also collects engagement data such as opens and clicks.

Every marketing email includes an unsubscribe link. You may also unsubscribe at any time by emailing privacy@alreadygone.net. Unsubscribing from marketing email does not affect transactional messages such as order or ticket confirmations.

4) SMS and Text Message Programs

We operate text message programs through short codes and also send text messages from our business telephone number, 346-800-4282. These are separate programs with separate consent.

Consent. We send marketing text messages only to people who have opted in to that specific program. Opting in to one program does not opt you in to the other. Consent to receive marketing texts is not a condition of any purchase.

What we collect. Your mobile phone number, your opt-in record and its date and source, your message history with us, and delivery and opt-out status.

Message frequency and rates. Message frequency varies. Message and data rates may apply.

How to opt out. Reply STOP to any message to opt out of that program. Reply HELP for assistance. You may also email privacy@alreadygone.net. Opting out of one program does not automatically opt you out of the other; reply STOP to each, or contact us and we will remove you from both.

Mobile information sharing restriction

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our SMS platform provider or customer service vendors, is permitted solely to operate the messaging program. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5) Content You Submit to Us

We invite fans to send us photos, video, audio, messages, and other content. Submissions are collected through a third-party platform hosted at app.memogram.io, which processes submissions on our behalf and maintains its own privacy practices governing its service.

What we collect. The content you upload, any name, email address, or message you include with it, and technical information generated during upload such as file details and timestamps.

How we use it. We use submitted content for the purpose described at the time of submission, which may include reviewing it, sharing it with members of the band, and, where you have given permission, featuring it in our communications, on our website, or on our social media channels.

Please note. Content you submit may include images or voices of you or other people. Please submit only content you have the right to share, and obtain permission from anyone else who appears in it. Do not include sensitive personal information in a submission.

Removal. If you want a submission deleted, email privacy@alreadygone.net and we will remove it from our systems, though we may be unable to recall material already published or shared.

6) Cookies, Advertising, and Tracking

A) What are cookies?

Cookies are small files stored on your device. We also use similar technologies such as pixels and tags that collect information about your browsing activity.

B) Types of cookies we may use

  • Strictly necessary: required for the Site to work, including security, login, and cart functionality
  • Preferences: remember settings and choices
  • Analytics: help us understand Site usage and performance
  • Advertising and targeting: help deliver and measure ads, including retargeting

C) Interest-based advertising

We may work with advertising partners that collect information through cookies and pixels to show you ads that may be more relevant, measure campaign performance, and limit how often you see an ad. These partners may collect data across different websites or apps, often called cross-context behavioral advertising.

D) Your cookie choices

  • Browser controls: you can block or delete cookies through your browser settings, though some Site features may not function
  • Advertising opt-outs: you may be able to opt out of certain interest-based ads through industry tools such as those offered by the DAA and NAI

Global Privacy Control (GPC). Some jurisdictions treat GPC signals as a request to opt out of certain data uses such as targeted advertising or the sale or sharing of personal data. Where required by applicable law, we treat recognized opt-out signals, including GPC, as opt-out requests for the relevant processing.

7) How We Share Information

A) Service providers

Vendors that help us operate the Services, including website and ecommerce hosting, payment processing, shipping and fulfillment, email marketing, SMS delivery, ticketing, content submission and hosting, customer support tools, analytics providers, and security and fraud-prevention services. These vendors may use information only to provide services to us, subject to contract and applicable law.

B) Advertising and marketing partners

We may share identifiers and usage data with advertising partners to deliver and measure advertising. This does not include mobile opt-in data or SMS consent, as described in Section 4.

C) Venues and event partners

Where necessary to fulfill a request relating to a performance, such as guest list or will-call arrangements you have asked us to make.

D) Publication of submitted content

Where you have given permission, content you submit may be published on our website, in our communications, or on public social media platforms, where it may be visible to anyone.

E) Legal and safety

We may disclose information to comply with the law, respond to lawful requests, protect rights and safety, prevent fraud, or enforce our terms.

F) Business transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

We do not sell or rent your personal information for money.

8) Sale, Sharing, and Targeted Advertising Opt-Out

Some privacy laws give you the right to opt out of targeted advertising, the sale of personal data, and the sharing of personal information for cross-context behavioral advertising.

To opt out, email privacy@alreadygone.net with the subject line “Privacy Opt-Out Request.”

9) Your Privacy Rights

Depending on where you live, you may have rights including:

  • Access: confirm whether we process your personal data and obtain access to it
  • Correction: correct inaccuracies
  • Deletion: request deletion of your personal data
  • Portability: obtain a copy of your data
  • Opt out: opt out of targeted advertising and certain data sharing or sale

The Texas Data Privacy and Security Act (TDPSA) provides Texas residents with rights including access, correction, deletion, and opt-out of targeted advertising and the sale of personal data. Residents of other states may have comparable rights under their own laws.

To exercise these rights, email privacy@alreadygone.net with the subject line “Privacy Rights Request.” We may ask you to verify your identity before fulfilling certain requests. If we deny your request, you may appeal by replying to our response with the subject line “Privacy Appeal.”

If you have an account, you may also be able to review and update certain information directly through your account settings.

10) Data Retention

We keep personal data only as long as necessary for the purposes described in this Privacy Policy, including maintaining your account, completing transactions, providing customer support, maintaining mailing list subscriptions, and resolving disputes. We retain SMS and email opt-in and opt-out records for as long as needed to demonstrate compliance with applicable messaging laws. Submitted content is retained until you ask us to remove it or until it is no longer needed for the purpose it was submitted for. Retention periods vary depending on the type of data and why it was collected.

11) Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal data. However, no system is completely secure, and we cannot guarantee absolute security.

12) Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13, including through account registration or content submission. We do not knowingly send marketing text messages to anyone under 18. If you believe a child has provided personal information, contact us at privacy@alreadygone.net and we will delete it.

13) International Visitors

If you access the Services from outside the United States, your information may be processed in the United States and in other locations where our service providers operate. Data protection laws in those locations may differ from those in your country.

14) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date indicates when revisions were made. Your continued use of the Services after changes take effect means you accept the updated policy.
